4. Trademark registration application
Once you verify in the list of the trademark search report that your name is not registered or in the process of being registered, go to: https://registro.propiedadintelectual.gob.ec/solicitudes/
Enter you username and password from your virtual locker. Button: Acceder.
Click in Registro > Solicitud de Signos distintivos.
Denominación del Signo (Name of the sign)
Proceed to fill in the data of your brand:
Select the office where you want your procedure to be carried out (the one closest to your home)
Denominación del signo (Name of the sign):
Naturaleza del signo (Nature of the sign)
Denominativo: if you want to protect only the name
Figurativo: if you want to protect only the logo
[Recommended] Mixto: if you want to protect the name and logo.

For products: Marca de producto. Ex: Clothes brand like Nike.
For services: Marca de Servicios. Ex: restaurants or hotels.

You must start by ratifying the denomination to be protected, you must make the description of the logo or design so clear that anyone can read your description and it is easy to imagine it without seeing it. It must be written in Spanish.
Example in Spanish:
La denominación consiste en THE WOW SPACE y su logotipo que se construye con un rectángulo semiabierto en perspectiva que contiene las palabras The WOW space, tipografía Varela Rounded. La palabra WOW se posiciona en el centro sobresaliendo del rectángulo. El rectángulo y la palabra WOW se presentan en color turquesa 89C 0M 17Y 0K / #00B4D8. Las palabras The y Space se presentan en color negro.
The words that are not part of the denomination that appears in the logos must be explained in the * Descripción clara y completa del signo:, however, it should be clarified that it is not part of the denomination. It must be written in Spanish.
Example in spanish:
Debajo del logo de The Wow Space se encuentran las palabras Lodge Hotel, aclaro que las palabras Lodge Hotel son con fin informativo, por lo que no me reservo el derecho de exclusividad sobre las mismas.
Attach image (adjuntar imagen) (in case of figurativa or mixta trademarks)
You must attach a file with a .jpg extension, with a maximum size of 16 MB, and measures 5 x 5 cm.

Enter the Nice class number of your product or service. To consult the class corresponding to your trademark, click here.
Tips for Nice class selection:
Trademarks of manufacturing or factory products: Nice class from 1 to 34.
Trademarks of services: Nice class from 35 to 45.
Trade name (Nombre Comercial) (code, not Nice class) 91, everything related to purchase, sale, import, export or a commercial label, as long as the commercial activity is in a specific place and works with billing. In Detalle write: Actividades relacionadas con la venta y comercialización de (productos o servicios).
Example for a hotel brand
Actividades relacionadas con la venta y comercialización de servicios de alojamiento, alquiler de salas de reuniones, cafetería, restaurante, tratamientos de belleza y bienestar, spa, alquiler de casas de vacaciones, servicios de agencias de viajes y operadoras, transporte y servicios turísticos.
Ejemplo for a clothe brand:
Actividades relacionadas con la venta y comercialización de textiles.
Priority
Priority is the possibility of registering a trademark in Ecuador, with the same date on which it was filed in another country of the Andean Community, as long as it is done within the six months following the date on which the first application was filed.
Fill in only if the trademark has been previously registered in another country.

It is not necessary for a lawyer to do this process. You can do it yourself.

This field will only be activated if it is a legal person and you must attach the name of the legal representative.
Descuento (discount)
Attach: Certificado de descuento extended by the financial area of SENADI as MIPYMES.
You must attach a file with a .pdf extension, with a maximum size of 16 MB. Discounted price: $104.
If you do not have it, you can continue with the procedure with the normal price of $208.

Once the receipt has been generated, you can search for it in the list of Pending and Completed Requests (Solicitudes Pendientes y Finalizadas)

This will happen next...
If the application was filled out correctly and passes the formal examination, it will appear in the Intellectual Property Gazette (Gaceta de Propiedad Intelectual): this publication is for third parties who believe they are affected by the possible registration of the requested trademark, to present opposition in the event that the sign has any resemblance to your trademark. You can review the latest gazette by searching in Google with the keywords: Gaceta Senadi Ecuador.
The # of the gazette in which your application will be published can be consulted sending an email to info@senadi.gob.ec with the application number.
Oposition: Within the term of thirty business days following the date of publication in the gazette, whoever has a legitimate interest may submit substantiated oppositions.
Registrability examination: if there is no opposition, the registrability examination is carried out in which it is decided to accept or reject the trademark.
Issuance of the title (as long as the mark has been granted).
