3. Trademark search (phonetic search)

This step will allow you to know if the trademark name we want to register is available, has similarity to a trademark or someone has already registered it in Ecuador.

At the end of the procedure you will get the results of the phonetic trademark search.

If in the results we see an exact similarity (it is spelled and sounds the same), or very similar to another name or activity (Luna Florería and Luna Flowers for example), we suggest thinking of another name.

(RECOMMENDED) To obtain results of a phonetic search, with a cost of $16, which includes more fields of information and issued by SENADI, follow these steps:

Voucher generation (Generación del comprobante)

1. Go to https://registro.propiedadintelectual.gob.ec/solicitudes/

2. Write your username (usuario) and password (contraseña) for the virtual locker. Press Access (acceder) button.

3. Go to Pagos - option Trámites no en línea

4. Press Generar Comprobante

5. Fill in:

   • In Documento, enter your ID number

   • Enter the code 1.1.10. or at leat 3 characters of the description of Tasa de Pago: Informe de búsqueda general de signo distintivo

   • A box will appear with the value $16

   • Tipo de Documento: Cédula or Pasaporte or RUC or Empresa extranjera

   • Número de Documento: ID number of the document type

   • Name: Complete, as it appears in the document type

   • Teléfono: (optional)

   • País de Nacionalidad: (fill if the field is active, if not, leave it as it appears)

   • Provincia de Residencia (optional)

   • Ciudad de residencia (optional)

   • Email (optional)

   • Fax (optional)

6. Press Generar Comprobante

Voucher payment (pago del comprobante)

1. Once the voucher has been generated, you can search for it in the list of generated vouchers (comprobantes generados)

   TIP: Sort by date to find the recent voucher

2. Click in Ver Comprobante, download it and print it.

3. Payment:

   2. Direct payment at Banco del Pacífico: Do not forget to bring the comprobante de ingreso downloaded in point 2. You do not need to validate your payment.

   3. Wire transfer:

      • Banco del Pacífico

      • Checking account (cuenta corriente): 7877889

      • Name: Servicio Nacional de Derechos Intelectuales

      • RUC: 1768190490001

      • Validate your proof of payment sending an email to: aguerra@senadi.gob.ec

        • Attach:

          • Transfer validation request signed in PDF format. You can fill it out and download it here

          • Comprobante de Ingreso generated in the Online application System (point 2)

4. Once you have made the payment, download or take a photo of the proof of payment for the next step.

Phonetic trademark search report Request

1. Download and fill this trademark search request, save the file as PDF: Solicitud de búsqueda fonética.

2. Send an email:

   • To: info@senadi.gob.ec

   • Subject: BÚSQUEDA FONÉTICA [NOMBRE EXACTO DE LA MARCA]

   • Message:

Estimados Senadi:

Por favor realizar búsqueda fonética de [WRITE HERE THE EXACT NAME OF THE TRADEMARK]

Adjunto documentos.

• Attach 3 files: Trademark search request, the voucher (Comprobante de ingreso generado) and Proof of transfer or deposit payment.

Trademark revision

1. Once you have received the phonetic trademark search report in your email, you should carefully check that there is not a similar or the same trademark registered.

2. If there is a similar or same trademark registered, you should check which Niza class it is in. If it is in the same class you want to register, you should look for another denomination.

3. If there are similar trademarks registered, but in a different Niza class, you can start the registration process.
